JUDGE REFUSES ANNULMENT PLEA A petition by a woman to have her marriage annulled on the ground her husband failed to keep a promise, to embrace her faith was Thursday when the court said her testimony indicated she not practicing the faith too Supreme Court Justice Carlton A. Fisher denied the application of Mrs. Marlene A.

Brown, of 16 LaForce for an annulment of her marriage to Lauren G. Brown. The couple was married April 12, 1952 and have two children, and years old. Justice Fisher said in a memorandum that Mrs. Brown testified her husband promised to embrace the Roman Catholic faith and to bring up the children in that faith but failed to keep his promise.

"Plaintiff professes great religious faith and membership, in the Roman Catholic Church but her testimony indicates that she is not a contributing member of any parish and she does not know the name of her priest," said Justice Fisher. "She claims that she only discovered the fraud of the defendant within the past three years, but that is incredible in view of the fact that she has been married 1952 and has had these since, children two apart. "Under the circ*mstances it is very apparent that the, has not instituted this action within the time prescribed by the Legislature (three years) and also from the evidence it is apparent that she has not been deceived, and that if she was deceived, that it was not a material element in entering into the marriage ceremony, She has failed to prove the cause of action and the complaint is dismissed upon the merits." 1-YEAR TERM GIVEN ON WEAPON CHARGE The maximum sentence of one year in the penitentiary and a $500 fine for a misdemeanor charge of possessing a dangerous knife was imposed today on Oscar Lake, 33, of 31 Walnut who flourished the weapon in Welfare Dept. office at 210 Pearl St. Judge Jacob A.
